२२ माघ, काठमाडौं । गण्डकी प्रदेशका मुख्यमन्त्री सुरेन्द्रराज पाण्डेले सीमित स्रोत र साधनको दायरामा रहेर पिन प्रदेशको समन्यायिक विकासलाई प्राथमिकतामा राखेको बताएका छन् ।
प्रदेशको आठौं स्थापना दिवसको अवसरमा उनले सीमित स्रोत र साधनको दायरामा रही नागरिकका असिमित चाहना पूरा गर्न सहज नभएको पनि बताए ।
मुख्यमन्त्री पाण्डेले प्रदेश स्थापनाको यो ७ वर्षको अवधिमा भौतिक र कानुनी आधार निर्माण गर्दै अधिकारका लागि संघ सरकारसँग जुधिरहनुपरेको पनि बताए । ‘संघीय शासन व्यवस्थाको सबलीकरणका लागि गण्डकी प्रदेश सरकारले सुरुदेखि नै अगुवाइ गर्दै आएको छ’, उनले भने ।
०८० असारमा गण्डकी प्रदेश सरकारको अग्रसरतामा पोखरामा राष्ट्रिय समन्वय परिषद र अन्तरप्रदेश मुख्यमन्त्रीको पहिलो बैठक भएको थियो । जसमा प्रहरी समायोजन, वित्तीय समानीकरण, निजामती कर्मचारी ऐन, विद्यालय शिक्षा ऐन, जग्गा प्राप्ति लगायत विषयमा विभिन्न निर्णय भएका थिए । ‘तर कार्यान्वयनमा खासै प्रगति हुन सकेको छैन । जसका कारण जनअपेक्षा अनुरुप कार्य गर्न कठिनाइ रहेको छ’, उनले भने ।
मुख्यमन्त्री पाण्डेले गण्डकी प्रदेशबाट हालसम्म विभिन्न ७२ कानुन, २५ नियमावली र अन्य आवश्यक मापदण्ड जारी गरेको जानकारी दिए । उनले अझै केही विधेयक संसदमा छलफलकै क्रममा रहेको र केही टेबल हुने क्रममा रहेको बताए ।
क्यान्सर, पक्षघात जस्ता घातक रोगबाट पीडित नागरिकका लागि चालु आर्थिक वर्षमा एक करोड ६४ लाख रुपैयाँ आर्थिक सहायता प्रदान गरिएको पनि प्रदेश सरकारले जानकारी दिएको छ । त्यस्तै यसै वर्ष आँपपिपल र बुर्तिबाङ अस्पताललाई ५० शैयामा स्तरोन्नति गरी प्रदेश सरकार मातहत ल्याइएको र लमजुङ अस्पताल पनि प्रदेश सरकार माहतहत आएको मुख्यमन्त्री पाण्डेले जानकारी दिए ।
यसअघि माघ २२ मा गण्डकी प्रदेशसभा र फागुन ४ मा प्रदेश सरकारको स्थापना दिवस गरी छुट्टाछुट्टै मनाउँदै आए पनि यसवर्षदेखि स्थापना दिवसमात्रै मनाउने निर्णय गरेको हो । २०७४ माघ २२ गते गण्डकीमा पहिलो संसद् बैठक बसेको भएकाले त्यसै दिनलाई प्रदेश सभाले आफ्नो स्थापना दिवसका रुपमा मनाउन थालेको हो ।
नेपाल टेलिकमको नाफा ६ अर्ब २३ करोड
काठमाडौँ । नेपाल टेलिकमको खुद नाफा ६ अर्ब नाघेको छ । आर्थिक वर्ष २०८०/८१ मा कम्पनीको खुद नाफा ६ अर्ब २३ करोड रुपैयाँ पुगेको हो ।
२१औँ वार्षिकोत्सवमा पछिल्लो आर्थिक वर्षको आयव्ययसहितको विवरण सार्वजनिक गर्दै कम्पनीले गत आर्थिक वर्षमा ६ अर्ब २३ करोड खुद नाफा भएको जानकारी गराएको हो ।
कम्पनीले गत आर्थिक वर्षमा कमाएको खुद नाफा अघिल्लो आर्थिक वर्षको तुलनामा कम हो । यद्यपि कम्पनीले अर्थतन्त्रका सूचकहरु नकारात्मक भएको अवस्थामा कम्पनीले नाफा आर्जन गर्नु नै ठूलो कुरा भएको भनेको छ ।
कम्पनीका अनुसार चालु आर्थिक वर्षको ६ महिना (साउनदेखि पुषसम्म) करिब २० अर्ब १२ करोड रुपैयाँ आय आर्जन गरिसकेको छ । हालसम्म टेलिकमको ग्राहक संख्या २ करोड १२ लाख ४२ हजार बढी पुगेको कम्पनीले जनाएको छ ।
नक्कली नाफा देखाउने नेफ्स्कुन सञ्चालकलाई १० वर्षसम्म कैद हुन सक्ने
२२ माघ, काठमाडौं । वित्तीय विवरणमा नै छेडखानी गरी नक्कली देखाउने नेपाल बचत तथा ऋण केन्द्रीय संघ (नेफ्स्कुन) का पदाधिकारीलाई १० वर्षसम्म कैद हुन सक्ने देखिएको छ ।
नेफ्स्कुनले खराब कर्जाबापत गर्नुपर्ने नोक्सानी व्यवस्था (लोनलस प्रोभिजनिङ) नराखी नक्कली नाफा देखाएर लाभांश बाँड्ने निर्णय गरेको थियो ।
आफ्ना सदस्यहरूले लाभांश दिनुपर्ने माग गरेपछि वित्तीय विवरणमा हुँदै नभएको नाफा देखाएर प्रतिफल दिने निर्णय गरेको नेफ्स्कुन अध्यक्ष चन्द्रप्रसाद ढकालले पनि स्वीकार गरेका छन् ।
यसरी नक्कली विवरण तथा मिति, अंक वा बेहोरा फरक पार्ने कसुर गरे १० वर्षसम्म कैद हुने सहकारी ऐन २०७४ को दफा १२२ र १२४ मा छ ।
‘सहकारी संस्थाको कुनै कागजात वा खातामा लेखिएको कुनै कुरा कुनै तरिकाले हटाइ वा उडाइ अर्कै अर्थ निस्किने बेहोरा पारी मिलाइ लेख्ने वा अर्को भिन्नै श्रेस्ता राख्नेजस्ता काम गरेबाट आफूलाई वा अरू कसैलाई फाइदा वा हानि नोक्सानी गर्ने उद्देश्यले किर्ते गर्न वा अर्काको हानि नोक्सानी गर्ने उद्देश्यले नगरे वा नभएको झुट्टा कुरा गरे वा भएको हो भनी वा मिति, अंक वा बेहोरा फरक पारी सहीछाप गरी गराइ कागजात बनाइ वा बनाउन लगाइ जालसाजी गरे वा गराएमा’ मा त्यो कसुर गरेको मानिने ऐनको दफा १२२ को खण्ड (ढ) मा उल्लेख छ ।
गलत वित्तीय विवरण प्रकाशित गरेको भन्दै संस्थाको लेखा परीक्षकले नै विपरीत राय लेखेको छ ।
त्यस्तै, दफा १२२ को खण्ड (ढ) अनुसार कुनै कसुर गरे १० वर्षसम्म कैद हुने व्यवस्था ऐनको दफा १२४ को दफा १ मा उल्लेख छ ।
सहकारी संघ तथा प्रारम्भिक संस्थाले तोकिए बमोजिम असल ऋणमा १ प्रतिशत, १२ महिनासम्म भाखा नाघेको ऋणमा कुल ऋणको ३५ र १२ महिनाभन्दा बढी भाखा नाघेको ऋणमा शतप्रतिशत ऋण हानि व्यवस्था (लोनलस प्रोभिजनिङ) गर्नुपर्ने सहकारी विभागको निर्देशनमा उल्लेख छ ।
नेफ्स्कुनले यो व्यवस्था अनुसार ४ अर्ब १७ करोड १० लाख ९० हजार कुल कर्जा नोक्सानी व्यवस्था गर्नुपर्नेमा जम्मा ५१ करोड ४० लाख १९ हजार मात्रै कर्जा नोक्सानी व्यवस्था गरेको खुलेको छ ।
यसरी गलत वित्तीय विवरण प्रकाशित गरेको भन्दै संस्थाको लेखा परीक्षकले नै विपरीत राय (एडभर्स अपिनियन) लेखेको छ ।
यसरी संघले कानुन अनुसार गर्नुपर्ने भन्दा ३ अर्ब ६५ करोड ७० लाख ७१ हजार कर्जा नोक्सानी व्यवस्था गर्द संघको सम्पत्तिमा त्यसको असर देखिने लेखा परीक्षण प्रतिवेदनमै उल्लेख छ ।
गर्नुपर्ने पूरै रकम प्रोजिभनिङ गरेको भए संस्थाको पूँजीकोष नै माइनसमा जाने थियो । संस्थाको कूल पूँजीकोष २ अर्ब २६ करोड ६३ लाख रुपैयाँ छ । ३ अर्ब ६६ करोड रुपैयाँ प्रोभिजनिङ गरेको भए संस्थाको पूँजीकोष नै १ अर्ब ४० करोडले माइनसमा जाने थियो । त्यति ठूलो मात्रामा पूँजीकोष घाटामा हुनु भनेको संस्था करिब धराशायी हुने अवस्थामा पुग्नु हो ।
तर, नेफ्स्कुनले वित्तीय विवरणमै छेडखानी गरेर प्रोभिजनिङ गर्नुपर्ने रकम नाफामा जोडी वित्तीय विवरणमै अदलबदली गर्ने कार्य जालसाजीमा पर्ने अधिवक्ता तथा सर्वोच्च अदालत बार एसोसिएसनका सचिव रमण कर्ण बताउँछन् ।
‘यहाँ वास्तविक स्रेस्ता नराखी गलत स्रेस्ता र हिसाबकिताब राखेर नक्कली नाफा देखाएको देखियो । यो सहकारी ऐनको दफा १२२ को खण्ड (ढ) अनुरूपको कसुर हो । त्यस्तो कसुर गर्नेलाई १० वर्षसम्म कैद हुने व्यवस्था ऐनमा छ,’ अधिवक्ता कर्णले भने ।
यस्तो कार्यमा सञ्चालक समिति र लगायत वित्तीय विवरणमा हस्ताक्षर गर्नेहरू दोषी हुने अधिवक्ता कर्ण बताउँछन् ।
लेखा परीक्षकले नै वित्तीय विवरण विश्लेषण गर्दा अधिकांश भाखा नाघेको कर्जा भएको र त्यसरी भाखा नाघेको कर्जाको जोखिम व्यवस्थाका लागि आवश्यक रकम व्यवस्था नभएको पाइएको उल्लेख गरेको छ ।
यसरी कर्जा नोक्सानी व्यवस्था नगरी सेयर लाभांश वितरण गरे वितरण गरिएको लाभांश सञ्चालक समिति र व्यवस्थापकबाट दामासाहीले असुल उपर गरिने पनि सहकारी विभागको निर्देशनमा छ ।
‘दफा १२२ को कसुर गर्ने वा त्यस्तो कसुर गर्न मद्दत पुर्याउने कुनै निकाय वा संघसंस्था भए त्यस्तो निकाय वा संघसंस्थाको प्रमुख कार्यकारी वा पदाधिकारी वा कार्यकारी हैसियतमा कार्य सम्पादन गर्ने व्यक्तिलाई यस ऐन बमोजिम सजाय हुनेछ,’ भन्ने व्यवस्था ऐनको दफा १२४ को उपदफा ३ मा उल्लेख छ ।
सहकारी विभागका रजिस्ट्रार पिताम्बर घिमिरे पर्याप्त कर्जा नोक्सानी व्यवस्था नगरी लाभांश बाँड्ने निर्णय गरेकोमा त्यसलाई सच्याउन निर्देशन दिएको तर यो काम ऐनको दफा १२२ अनुरूपको कसुर हो कि होइन भन्नेमा विभाग अझै स्पष्ट नभएको बताउँछन् ।
‘विभागले दिएको निर्देशनमा कर्जा नोक्सानी व्यवस्थाबारे उल्लेख छ, वित्तीय विवरणमा त्यसअनुसार गरेको नपाइएकाले तत्काल प्रोभिजनिङ गरेर विभागलाई रिपोर्टिङ गर्न भनेका छौं,’ उनले भने ।
पर्याप्त लोनलस प्रोभिजनिङ नगरी नाफा देखाएको र त्यस अनुसार लाभांश वितरण निर्णय गरेको विषय सहकारी ऐन अनुरूप कसुरमा पर्ने हो कि होइन भन्नेबारे थप अध्ययन र अनुसन्धान गर्नुपर्ने देखिएको उनले बताए ।
‘लेखा परीक्षकले नै पनि एडभर्स अपिनियन दिएको रहेछ, त्यसअनुसार हामीले नेफ्स्कुन र लेखा परीक्षकलाई बोलाएर पनि छलफल गर्यौं । विभागको निर्देशन उल्लंघन गरेकोमा त्यसलाई सच्याउन भनेको छौं, नगरे स्पष्टीकरण सोध्छौं,’ उनले भने, ‘दफा १२२ अनुरूपको कसुरमा दफा १२४ अनुरूप कानुनी कारबाही हुनुपर्ने हो कि होइन भन्नेमा दुई थरी मत आएकाले स्पष्ट भइरहेको अवस्था होइन ।’
नेफ्स्कुन अध्यक्ष ढकालले फेरि पनि सेयरधनीको मनोबल उकास्न त्यस्तो विवरण तयार गरेको बताए ।
‘सेयरधनीको मनोबल पनि उकास्नुपर्ने थियो । यस विषयमा अडिटरलाई सोधेका थियौं, उहाँले पनि प्रोभिजनिङ चाहिँ गर्नुपर्ने तर लाभांश वितरण गर्न रोक्ने कानुनी व्यवस्था नभएको भनेपछि त्यो पारित भएको हो,’ ढकालले दाबी गरे ।
‘तपाईं यसरी हाकाहाकी गलत वित्तीय विवरण बनाएको स्वीकार गर्नुहुन्छ, यसमा त सहकारी ऐनको दफा १२४ अनुरूप १० वर्षसम्म कैद हुनसक्छ नि ?,’ भन्ने प्रश्नमा उनले फेरि पनि पैसा वितरण गरी नसकेकाले कारबाही हुनु नपर्ने दाबी गरे ।
तर, यो पैसा वितरण गर्नेभन्दा पनि गलत विवरण तयार गरेको विषय भएको बताएपछि उनले प्रमुख कार्यकारी अधिकृत (सीईओ) डा. शिवजी सापकोटासँग कुरा गर्न भने ।
नेफ्स्कुन सीईओ सापकोटाले पनि लाभांश नदिँदा सेयर लगानीकर्तामा वितृष्णा आउने भएकाले त्यसलाई रोक्न लाभांश वितरण गर्न मिल्ने वित्तीय विवरण तयार गरिएको स्वीकार गरे ।
‘लाभांश दिँदा सदस्यहरूलाई राहत हुने र समग्र सहकारी अभियानमा पनि सकारात्मक सन्देश जान्छ भन्ने सल्लाह भएर त्यस्तो गरिएको हो, तर सहकारी विभागले त्यसलाई सच्याउनु भनिसकेको अवस्थामा सच्याउँदै छौं,’ उनले भने ।
संस्थाको कर्जा असुली सकारात्मक पनि बनेको अवस्थामा लाभांश वितरण गर्नुपर्छ भनेर त्यस्तो रिपोर्ट बनाइएको र साधारणसभामा लगिएको उनले बताए ।
बचत ऋण सहकारीको नियामकीय भूमिका समेत पाएको केन्द्रीय संघ नेफ्स्कुनले त्यसमा सुधार गर्नुको सट्टा त्यही गल्ती पटक–पटक दोहोर्याउँदै आएको छ ।
‘लेखा परीक्षकले पनि लाभांश वितरण गर्न नमिल्ने कुरा ऐनमा छैन, निर्देशनमा छ । तपाईंहरूले विचार गर्नुस् भनेपछि बाँड्ने निर्णय गरिएको हो, यसमा कुनै व्यक्तिगत वा समूहको स्वार्थ छैन,’ सीईओ सापकोटाले दाबी गरे ।
नेफ्स्कुनको लेखा परीक्षण गर्ने एनएआरएस एसोसिएट्सका म्यानेजिङ पार्टनर राजन अधिकारीले केही समयअघि अनलाइनखबरसँग कुरा गर्दै आफूले कैफियत र संस्थाको अवस्थाका सन्दर्भमा आफ्नो राय लेखा परीक्षण प्रतिवेदनमा नै लेखेको बताएका थिए ।
पर्याप्त प्रोभिजन नगरी नाफा देखाएर लाभांश वितरण गरेको भए अर्को वर्षको लेखा परीक्षण प्रतिवेदनमा आफ्नो राय दिने भन्दै त्यस विषयमा अहिले आफूले कुनै टिप्पणी नगर्ने उनको भनाइ थियो ।
यसअघि नेफ्स्कुनले खराब कर्जाबापत प्रोभिजनिङ गर्नुपर्ने पौने ४ अर्ब रुपैयाँ नाफामा देखाएको विषयमा अनलाइनखबरले समाचार प्रकाशित गरेपछि सहकारी विभागले त्यसलाई सच्याउन निर्देशन दिएको थियो ।
तर, नेफ्स्कुनले पहिलो पटक यस्तो गल्ती गरेको होइन । अघिल्लो आर्थिक वर्ष २०७९/८० मा पनि खराब कर्जाबापत गर्नुपर्ने भन्दा साढे ५ अर्ब रुपैयाँ कम प्रोभिजनिङ गरी नाफामा लेखांकन गरेको थियो ।
राष्ट्र बैंकसहित विभागको अनुगमन टोलीले नेफ्स्कुनको वित्तीय विवरण विश्लेषण गर्दा अधिकांश भाखा नाघेको कर्जा भएको र त्यसरी भाखा नाघेको कर्जाको जोखिम व्यवस्थाका लागि आवश्यक रकम व्यवस्था नभएको पाइएको उल्लेख छ ।
त्यसबेला पनि लेखा परीक्षकले वित्तीय विवरणमै विपरीत राय (एडभर्स अपिनियन) दिएका थिए । सहकारी विभागले समेत त्यस्तो कार्य सच्याउन निर्देशन दिएको थियो ।
तर, बचत ऋण सहकारीको नियामकीय भूमिका समेत पाएको केन्द्रीय संघ नेफ्स्कुनले त्यसमा सुधार गर्नुको सट्टा त्यही गल्ती पटक–पटक दोहोर्याउँदै आएको छ ।
अघिल्लो पटक जस्तै यसपालि पनि त्यसरी प्रोभिजनिङ गर्नुपर्ने रकमबाट कागजी नाफा देखाएर नेफ्स्कुनले सेयरधनीलाई लाभांश बाँड्न साधारण सभाबाट पारित पनि गरेको थियो ।
पर्याप्त कर्जा नोक्सानी व्यवस्था नगरी मुनाफा देखाएर सेयर लाभांश कोषमा रकम छुट्याउने कार्य सहकारी विभागले जारी गरेको सहकारी संघसंस्था सुशासन प्रवर्द्धनका लागि एकीकृत निर्देशन २०७९ समेतको विपरीत हुन्छ ।
विभागले जारी गरेको उक्त निर्देशनको २० नम्बर बुँदामा तोकिए अनुसार कर्जा नोक्सानी व्यवस्था नगरी सेयर लाभांश वितरण गरे त्यस्तो रकम सञ्चालक समितिबाट उठाउने व्यवस्था छ ।
गत वर्ष नै लेखा परीक्षकले संघको वित्तीय अवस्था जोखिमपूर्ण रहेको देखाएपछि नेपाल राष्ट्र बैंकबाट विज्ञ जनशक्ति समेत मगाएर सहकारी विभागले नेफ्स्कुन अनुगमन गरेको थियो ।
अनुगमन क्रममा पर्याप्त कर्जा नोक्सानी व्यवस्था नभएको वाह्य लेखा परीक्षकको प्रतिवेदन समेतका आधारमा संघमा वित्तीय रूपमा समस्यामा रहेको निष्कर्ष निकालिएको थियो ।
सोही अनुगमन प्रतिवेदन आधारमा सहकारी विभागले कर्जा नोक्सानी व्यवस्था पर्याप्त गर्नुपर्ने निर्देशन सहित ६ महिना समय दिएर सुधार गर्न निर्देशन दिइएको थियो ।

NEW DELHI: The lack of form of Sanju Samson has alarmed former India spinner Ravichandran Ashwin, who claims that if he does not find a way out of his current rut, his mind may begin “playing tricks” with him.
Samson, 30, had a miserable series against England’s quick pace and short balls and will be sidelined for a month owing to a fracture in his right index finger.

Only 51 runs were scored by him in the five-match match, which India won 4-1.
“…if Sanju keeps getting dismissed like this, as a batter, the mind will be playing tricks,” Ashwin said.
“(It will force you to think) the bowler is bowling a certain way and I am getting dismissed like this, is the bowler bowling well or do I have a shortcoming? Will I be able to adapt? Once so many questions arises, then it becomes difficult,” he explained.
Ashwin also suggested that out-of-form captain Suryakumar Yadav alter his strategy in order to break out of the current rut in form that he is experiencing. Suryakumar’s run total in the recently finished series against England was barely 28.
“I can understand it happening in one or two games, but it is quite surprising,” Ashwin said on his Hindi YouTube channel.
“…when you know you are being attacked in a certain way, there should be a different approach to that ball or just avoid it and force the bowler to bowl at your strengths.”
“Suryakumar Yadav is a very experienced guy. He has a lot of ability. One can say he brought about a change of guard in Indian batting, showing the way. But the time has come for him to take some time out and change his approach,” he added.
Samson, who has fluctuated in his performance during his career in international cricket, should respond appropriately, according to Ashwin, to prevent doubts from infiltrating his subconscious mind.
But Ashwin cited legendary Sachin Tendulkar‘s advice during last week’s BCCI Naman Awards that players should use their subconscious mind too.
“Sachin Tendulkar also said during the (BCCI) awards function that (you must) do so many repetitions that you allow the subconscious mind to take over,” he said.
“But if so much confusion comes over on the subconscious mind, then batting becomes a different ball game altogether.”
Failure in T20 cricket, according to Ashwin, is not the issue; rather, the way dismissals are handled can raise questions.
“As an experienced cricketer I will not focus on someone failing in T20 cricket but on how is he getting out, what is his decision making is like, I will focus on that. They are good enough players to find solutions and they will think over it,” he said.
A player’s ability to manage pressure in the shortest formats is how they are always evaluated, according to Ashwin.
“T20 cricket is (all) about failures, you are bound to fail. You will not be able to play percentage cricket. As per this, I will think (about) the player who can handle pressure and can deliver wins,” he said.
“Those players can be given long rope because T20 cricket is not about consistency, it’s about excitement, putting fear in the opposition.”
Ashwin was also taken aback by England’s tactics in all forms, claiming that their aggressive approach is costing them more games than they are winning.
“…if I was England, I would be really worried, because they play Bazball, one-day and T20 cricket… all that is fine,” he said.
“One can talk about it as much as they want, sometimes they pull off wins too. But I think they are losing more than they are winning so it is a serious matter of concern.”

NEW DELHI: The Supreme Court on Tuesday strongly criticised the Assam government for holding individuals declared as foreigners in detention centres instead of deporting them, asking sarcastically, “Are you waiting for some muhurat”.

“Once you declare a person foreigner, then you have to take the next logical step. You cannot detain them till eternity. Article 21 of the Constitution is there. There are many foreigner detention centres in Assam. How many have you deported?” the bench told the counsel appearing for the Assam government.
While hearing the case earlier, the court had noted that the right to life was not limited to Indian citizens but extended to all individuals, including foreign nationals. The court had asked for immediate steps to be taken to send them back to their respective countries.
The case pertains to 270 people currently held in detention centers and transit camps across Assam. Earlier, the apex court had pulled up the Assam government for not providing a clear explanation on why these individuals were being detained instead of being repatriated.
“We had granted six weeks to the state to file a compliance affidavit. The expectation was that the state would provide reasons for detaining 270 foreign nationals in transit camps and details of efforts made towards their deportation,” the bench had noted.
The counsel representing Assam informed the court that the deportation process involved coordination with the Union government. He explained that the state was responsible for compiling complete details of illegal migrants, including their contact addresses, and submitting them to the ministry of external affairs, which then verifies their identities through diplomatic channels.
Previously, the Supreme Court had directed the Assam State Legal Services Authority to conduct inspections at the Matia transit camp for foreigners to assess hygiene conditions and food quality.

NEW DELHI: Gujarat chief minister Bhupendra Patel on Monday announced the formation of a five-member committee to draft the Uniform Civil Code (UCC) for the state.
The panel, chaired by retired Supreme Court judge Ranjana Desai, has been tasked with preparing the draft and submitting its report to the state government within 45 days. The government will take a final decision based on the committee’s recommendations.
Announcing the decision, Gujarat CM Bhupendra Patel said, “The committee will submit its report to the state government in 45 days, based on which the government will take a decision.”
The move comes in the wake of Uttarakhand making history as the first Indian state to implement the UCC. Chief Minister Pushkar Singh Dhami recently launched a dedicated portal and issued a notification marking the adoption of the civil code.
The UCC aims to standardise personal laws across religions, covering matters such as marriage, divorce, inheritance, and live-in relationships. It seeks to ensure equal property rights, protect children’s rights, and impose penalties for non-compliance.
Under the UCC, legal provisions for marriage specify that only mentally capable individuals who are at least 21 years old (for men) or 18 years old (for women) and not already married can enter into a union. While marriages can still be performed according to religious customs, registration will be mandatory for legal recognition. The law also outlines regulations concerning the creation and cancellation of wills and codicils under testamentary succession.
Additionally, marriages solemnized before March 26, 2010, or those conducted outside the state, will be eligible for registration provided they meet legal requirements.
